Procurement

The value of purchases of goods, services and contracts by Swedish public sector entities is estimated to exceed SEK 500 billion every year. Public procurements are governed by strict regulations with which both buyers and sellers must comply. The aim of the regulations is for all potential suppliers to be treated equally, for there to be no discrimination and for procurements to be as predictable and transparent as possible.

Every day we help procurement authorities and suppliers on all issues concerning public procurement, both in the traditional sector and in the supply sectors, and the associated legal areas. Our advice covers all types of business transaction between procurement authorities and suppliers. In addition to issues related directly to procurement, we also provide advice on large projects, drafting contracts, negotiations, training and assistance in legal disputes.

We regularly assist our clients with the following:

  • Production of tender documents, notices, contracts and other documentation in individual procurements
  • Production of template documentation for procurement units
  • Quality assurance of tenders
  • Quality assurance of tender documents
  • Contract law advice and contract drafting
  • Scrutiny of award decisions
  • Issues relating to public access to documents and confidentiality
  • Litigatory advice
  • Acquisitions outside the area regulated by the law (for example services concessions and pre-commercial procurements)
  • Reviews and actions for damages
  • Lectures and training

Law may very well be enjoyable and interesting in itself, but to a lawyer it should primarily be a tool for finding and achieving practically feasible solutions for the client, whether it be in negotiations, disputes or other circumstances. Sustainable solutions can reasonably only be found if we familiarise ourselves with you, our clients, and understand your business and reality.

My experience essentially concerns commercial law in a broad sense. My primary focus today is partly on corporate law (with regular assignments as special examiner, and as trustee or arbitrator in connection with redemption of shares), and partly on public procurement and competition law (with more than 25 years of experience of advising and assisting contracting authorities and suppliers). In the field of distribution, I work primarily on international agent and distribution contracts. I am also pleased and grateful that I am regularly engaged for advice and board positions in foundations. I give regular lectures in the above subject areas.

Internationally, I am involved in the European Law Group, a network of commercial law firms in Europe, am engaged by the EU Commission as an expert in relation to innovation procurement and I am the Swedish representative of the International Distribution Institute (IDI), an international body working in agent, distribution and franchise law.

I have been a member of the Swedish Bar Association since 1991 and co-founded Sigeman & Co later the same year.

As your lawyer, it is essential for me to totally understand your reality. Finding and arguing in favour of various solutions is what makes my work such an enjoyable challenge. I can really make a difference for you, our client, by being involved in processes when problems are formulated based on what you want to achieve.

My work at Sigeman & Co primarily concerns general commercial law, with a particular focus on public procurement — among other things, I am the co-author of JP Infonet’s comments on the Swedish Public Procurement Acts (2007:1091) and (2016:1145). I have extensive experience of working in both Swedish and English.

Since 2007 I have been working a great deal in the energy industry on everything from public procurement to construction contract law, property law and contracts for public law and EU law. I am also one of the firm’s representatives at Associated European Energy Consultants (AEEC).

I have been part of Sigeman & Co since 2007 and a member of the Swedish Bar Association since 2011.
